Terms & Conditions

 

These Terms and Conditions form part of the license to Occupy. By completing a booking request and subsequently having Luxuria Apartments confirm acceptance of your booking you have confirmed acceptance of the Terms and Conditions as follows:

 

Nightly Rental Rate

  1. The nightly rental rate covers the cost of the property including furnishings and utilities including internet. There may be additional charges for any extra services requested by the Guest.

 

Licence to Occupy

  1. Guests are granted the Licence to Occupy the property as a residential premises only for the specified dates once the reservation has been paid in full.
  2. Luxuria Apartments properties are not, under any circumstances, to be used for any business or commercial enterprise.
  3. If you breach any of the Terms and Conditions this may cancel your licence to occupy and result in eviction without refund.  Should you not vacate the premises you will be trespassing.

 

Security Deposit

  1. A security deposit is payable two (2) days prior to the scheduled check-in date.
  2. The security deposit is paid to Luxuria Apartments on the condition that Luxuria Apartments will repay it if and when due. The deposit, less due and unpaid nightly rental rate, damage charges, extra cleaning charges, cancellation fees and any chargeback fees will be refunded within 10 working days after the confirmed checkout date following settlement of all accounts owing. In the event of a shortfall the Guest agrees to pay such shortfall to Luxuria Apartments immediately on demand.

 

Payment Terms

  1. All reservations are to be paid in full at the time of booking.
  2. Payment can be made by debit card, credit card or bank transfer only.
  3. You must only provide credit card details for which you are authorised to use.
  4. Use of American Express incurs a surcharge of 3%.
  5. Invoices are issued, and payment must be made, in Australian dollars.

  

Cancellation Policy

  1. If a guest requests to cancel:
    • 60 days or more – Cancellations made 60 days or more prior to the check-in date will be refunded in full.
    • 30 days to 59 days – Reservations cancelled more then 30 days and less then 59 days before check-in will receive a 50% refund.
    • Less then 30 days – All cancellations made less then 30 days before check-in are non-refundable.
  2. Once your booking has commenced if you wish to vacate the property earlier than the initial agreed term the remaining nights will be non-refundable.
  3. Date changes are only at the discretion of Luxuria Apartments and may incur cancellation fees as well as nightly rate charges (against the original booking).
  4. Luxuria Apartments reserve the right to cancel your reservation if the initial invoice is not paid in line with the Payment Terms above.
  5. Luxuria Apartments, in its sole discretion, may cancel a confirmed booking and refund the guest. Luxuria Apartments will always endeavour to provide alternative accommodation options. Luxuria Apartments will not have any liability for such cancellations or refunds.

 

Legal Capacity

  1. The guest acknowledges that they are at least 18 years of age and have full capacity to enter into this agreement. The primary Guest residing in the Luxuria Apartments apartment must be over 18 years of age and acknowledges that this condition shall be satisfied at all times, otherwise this agreement will be immediately terminated by Luxuria Apartments.

 

Owners’ Corporation (Body Corporate) Rules 

  1. As Luxuria Apartments properties are located in residential buildings with common property, Luxuria Apartments and all Guests are bound by the Body Corporate/Owners Corporation rules. The Guest agrees to abide by the rules of the Body Corporate/Owners Corporation at all times where a Body Corporate/Owners Corporation exists. Failure to abide by these rules may result in termination of your stay. A copy of the Body Corporate/Owners Corporation rules is located in your property for reference. You must familiarise yourself with these Rules to ensure compliance at all times. If you are unable to locate these in your property please contact Luxuria Apartments to request a copy of these Rules.

 

Check In and Check Out

  1. Check In and Check Out procedures will be detailed in the Property Information package forwarded to you following full payment of the reservation.
  2. Whilst we are more than happy to provide early Check-ins and late Check-outs wherever possible, this can only be confirmed at the last minute as it is dependent on other bookings at the time.
  3. Standard check-in time is after 2pm AEST on the day of arrival.
  4. Standard check-out time is before 11am AEST on the day of departure.
  5. Failure to adhere to those procedures could result in the incurring of additional costs.
  6. Photo ID will be required at the time of check-in.

 

Condition of Premises

  1. Luxuria Apartments will take all reasonable steps to make sure the premises are maintained in good repair. The Guest is required to make sure that care is taken to avoid damaging the property, car parking, storage area and any common areas and keep the property in a clean condition during the period of occupancy.
  2. Luxuria Apartments reserves the right to conduct inspections of all properties at anytime without notice to ensure compliance with this requirement. The Guest shall not use or allow the property to be used for any illegal purpose now allow any animals or pets on the property.
  3. Furnishings that are removed, become damaged, stained or suffused with cooking smells or other odors will result in the Guest incurring additional costs to cover the cost of repair, replacement or specialist cleaning of such items.

 

House Rules

  1. By accepting our Terms and Conditions the ‘booking name’ is deemed the Registered Guest.
  2. The Guest shall make sure that care is taken to avoid damaging the premises including any furniture.
  3. The registered guest is responsible for:
    • Any visitors and their behaviour while at the premises
    • Ensuring all guests and visitors are aware of the booking terms and conditions
    • The property and its contents for the entire period of the booking and will be liable for all breakages and damages however caused by any Guest or visitors regardless of whether you are present or not at the time the damage occurs.
    • Maintain and water all indoor plants. All of our plants are easy to care for; we ask that the Guest waters them once every 10 days to 2 weeks; unless other arrangements have been made with Luxuria Apartments.
  4. The number of guests staying at the property must not exceed the number agreed to in the booking details. There are no exceptions unless we approve additional Guests in writing. At our discretion additional costs may apply for any additional guests found to have been at the Property during your booking.
  5. A strict no party policy applies at all times in all our properties.
    • All guests are expected to behave in a manner that does not cause distress to neighbours or interfere in any way with their right to enjoy their properties.
    • Please keep noise to a minimum at all times.
    • Guests are required to enter and exit the property quietly.
    • Outdoor areas are not to be used after 10pm.
    • The noise level from inside the property must be inaudible from neighbouring properties between: 9pm and 9am Sun – Thu and 10pm and 9am Fri-Sat
  6. Guests may not engage in any illegal activity at the property. This includes any unauthorised usage of internet (illegal or illicit downloads).
  7. All Luxuria Apartments properties are non-smoking indoors and outdoors. There is no exceptions to this.  There may also be additional cleaning fees to remove any evidence of smoke fumes or butts from the property.
  8. You will agree to any other reasonable house rules which may be made available to you at the property.
  9. The owner or manager of the property may need access to the property occasionally. We will notify you by email or phone at least 24 hours prior, unless we have made verbal arrangements or it is a matter of urgency. If however we have reason to believe that the property is being used for any reason that contravenes our terms and conditions we reserve the right to enter the property without notice.
  10. We reserve the right to remove guests who do not adhere to the House Rules. In these cases, no refund will be due, and we will not be responsible for finding or funding alternate accommodation, nor will we be responsible for any other associated costs.
  11. The Guest shall allow Luxuria Apartments Consultants access to the property for the purpose of repairs and/or maintenance. For emergency maintenance Luxuria Apartments retains the right to enter the property immediately and to advise the Guest after the affect that the property was entered. Luxuria Apartments will make all reasonable attempts to notify the Guest prior to access.
  12. In the event that necessary building property maintenance work is required to be undertaken by a third party, the Guest acknowledged that nonessential and essential services including but not limited to electricity, water and internet may not be operative for the duration of the maintenance work period. The Guest acknowledges and agrees that they will not make any claim for compensation or loss against Luxuria Apartments. Luxuria Apartments shall endeavour to ensure that such property related services are resumed as soon as possible.

 

Breakages, Losses and Guest Charges

  1. You are responsible for leaving the property in the state in which you found it on arrival. All maintenance issues, breakages or losses must be reported immediately to us. The total cost of making good any other damage or loss to the property, garden or contents will be charged to the credit card provided for payment (or subtracted from the security deposit).
  2. It is our policy to have all locks changed if keys are lost or not returned. If this occurs all associated costs will be charged to the credit card provided for payment (or subtracted from the security deposit). Similarly any remote controls will be replaced at your cost if lost or not returned.
  3. Standard cleaning services on your departure are included in your rates. Guests are expected to leave the properties in a neat and tidy state without the need for extensive, excessive cleaning. You are responsible for all cleaning charges in the event that the property is left in a state that requires more than standard cleaning. This will be charged for using the credit card provided for payment (or subtracted from the security deposit).
  4. Reasonable usage of electricity, gas any other utilities or services (including internet) provided at the property are included in your rates.  Excessive use (more than a 20% increase compared to similar periods) of any of these utilities or services may be charged for using the credit card provided for payment (or subtracted from the security deposit). If charges are passed onto the Guest, evidence of charges will be provided on request.
  5. Neither Luxuria Apartments nor the owners of the property are liable for loss to you of any personal belongings while you are in the property. Guest items found by our cleaning staff are kept in the Luxuria Apartments office for 6 weeks before discarding. It is the guest’s responsibility to follow up any items that may have been left behind at the property. We request that guests send a reply paid envelope to Luxuria Apartments in order for us to return the items.
  6. Should the smoke alarm within the property be activated during your stay due to a false fire alarm (ie. cooking, burning of candles) you will take full responsibility for all costs incurred by the Melbourne Fire Brigade for attending, should they be called. To avoid such penalties, you agree to contact the Melbourne Fire Brigade immediately on 000 should a false fire alarm occur. You understand that Luxuria Apartments will not be held responsible for any associated costs for an incident of this nature.

 

Termination

  1. Breach of any of these Terms and Conditions may result in immediate termination of the stay and immediate eviction. Written notice will be given by email and by letter addressed to the Guest and a letter will be placed under the front door of the property.
  2. If a stay is ended due to breach of these Terms and Conditions the Guest accepts responsibly for all costs incurred including but not limited to rental to the required notice period, changing of locks, damage to the property and additional cleaning, legal or other costs uncured as result of a breach.

 

Disclaimer

  1. Neither Luxuria Apartments nor the owner of the property can be held responsible for failure or interruption to power or services to the property for reasons beyond our control.
  2. To the fullest extent permitted by law, Luxuria Apartments and the owner disclaim all warranties in relation to the provision of services and the use of the property, and otherwise our liability is limited at our option to the supply of the relevant services again or the payment of the cost of having services supplied again.
  3. Neither Luxuria Apartments nor the owners are liable for any indirect, incidental, special and/or consequential damage or loss of profits, which result from use of the property and services provided to you.
  4. Luxuria Apartments reserves the right to relocate a booking to an alternative property of similar standard and location at any time. In this instance, guests will be offered either a full refund OR asked to confirm their stay at the alternative property.
  5. Luxuria Apartments advises that the property furnishings may be slightly different to those shown in the property photos. However, if they differ, the furnishings will be of the same standard as that shown in the pictures, or higher.
  6. The Guest shall indemnify Luxuria Apartments for any loss or damage caused by failure to ensure that care is taken to avoid damaging the rented premises by the Guest or anyone on the premises with consent of the Guest.
  7. The Guest shall indemnify Luxuria Apartments against all liability in respect of injury or damage to any third person of third party property arising from any conduct, act or omission by the Guest, or the Guests invitees.
  8. Luxuria Apartments may amend these Terms and Conditions at any time. In this case the Guest will be notified in writing.
